Candidates File Emergency Court Action Seeking State Election Board Access to State Election Certification Process
FULTON COUNTY, GEORGIA — May 18, 2026 — Three Georgia candidates have filed an emergency legal action in Fulton County Superior Court seeking immediate judicial intervention to ensure the Georgia State Election Board (“SEB”) is granted full observational access to the statewide election tabulation and certification process conducted by the Georgia Secretary of State following the May Primary Election.
The plaintiffs — Chris Mora, Keli Gambrill and Greg Dolezal — argue that denying duly authorized SEB members access to observe the state-level certification process undermines transparency, weakens public confidence, and conflicts with the constitutional principle of free and open elections.
According to the filing, the Secretary of State’s Office declined requests from SEB members to observe the consolidation and certification process, while simultaneously allowing the SEB Chair limited access. Plaintiffs contend that selective access is arbitrary, inconsistent with the State Election Board’s statutory oversight authority, and contrary to the legislative intent behind reforms enacted by the Georgia General Assembly.
The complaint further asserts that the General Assembly intentionally restructured the SEB to operate independently from the Secretary of State by removing the Secretary as Chair and transferring investigative authority directly to the SEB. Plaintiffs maintain that denying the Board meaningful access to the state tabulation process effectively nullifies the independence the Legislature created.
“This case is fundamentally about transparency and public trust,” the filing states. “Georgia voters deserve assurance that election certification occurs openly, lawfully, and under proper oversight.”
The emergency filing requests:
Immediate injunctive relief permitting full SEB observational access;
A Temporary Restraining Order preventing exclusion of SEB members;
Declaratory relief affirming the SEB’s oversight authority during certification activities; and...
Any additional relief necessary to preserve confidence in the election process.
Plaintiffs also argue that irreparable harm occurs when election certification is conducted without full transparency or lawful oversight, particularly in a statewide election environment already subject to heightened public scrutiny.
The action was filed in Fulton County Superior Court due to the presence of multiple plaintiffs residing and campaigning within the jurisdiction and concerns regarding the urgent need for expedited judicial review before certification activities conclude.
